JMPD & SAPS Douglasdale, there is a better way to manage this. Come on guys. Regain public trust by defusing a situation with clear well managed instructions & actions.

In terms of the law, police officials have the right to obtain a blood specimen for DUI cases. So co-operate & dont fight the system or the police will have no option but to restrain you forcefully to get a sample.

What are our followers thoughts & opinions on this incident?

  1. Section 37 of the CPA applies, in this case the suspect appears to be resisting attempts to obtain a blood sample. Generally the officer making the arrest need only to have reasonable suspicion that the suspect may be over the legal limit, there is no requirement for breathalyzers tests. The police officers acted correctly to restrain the suspect. With regards to the person taking the video, the Police must also enure that even an arrested suspect’s dignity is preserved as far as possible. By recording this event and posting it on social media is actually a violation of the arrested suspect’s dignity and can lead to legal action against the person making the video. Let’s face it, if one of my family was arrested for suspected DUI I certainly would not what the entire world to see it. In addition posting photographic images of an arrested suspect can in some cases constitute a crime in itself such as defeating the ends of justice. So be very careful when you share this.

  2. My analysis from this clip is that whoever is going to take this matter to the court of law, the lady will win!!

  3. If she’s refuses to give blood she should be automatically charged as guilty, not subjected to that kind of restraint

Police are also people so when ever you did something wrong just cooperate with them and act cool and talk respectfully with them you will see they we feel for you I’m talking from experience I almost being arrested maybe three times in my life but because I talked nice and tell them the truth the let me go and give me a warning
