The Equality Court, sitting in the High Court in Johannesburg has declared the public display of the apartheid flag as hate speech. It says the display constitutes harassment. The Nelson Mandela Foundation brought the matter to court. The foundation says the display of the flag amounts to hate speech and unfair discrimination against black South Africans. Lobby group AfriForum challenged the move, saying it will violate freedom of speech. Deputy Judge President Phineas Mojapelo handed down the judgement.

  1. The South Gauteng High Court has ruled that the public display of the old SA flag amounts to hate speech, and is prohibited, subject to exceptions provided for in section 12 of the Equality Act.

    “s10(1) does not only apply to “words”, but includes all forms of expression.” Mojapelo DJP.

    “What then is their [those who support the old flag] objective intention? They intend to incite and awaken feelings of white supremacy against black people…” Mojapelo DJP.

    “Any gratuitous display of the old flag demonstrates a clear intention to be hurtful and harmful against black people and constitutes hate speech.” Mojapelo DJP.

  3. Apartheid is a forgiven past horrible act against a certain group of people, but not forgotten. Therefore anything that’s got to do with it does not qualify for any freedom of speech. We are not equal in that regard. If we were oppressed by apartheid, it would make sense if anything that’s got to do with apartheid give us the space and respect we deserve. Bottom line is don’t remind us our horrible pain that you’ll never understand so there won’t be more hatred from us as black people. This is a non-debatable topic. Period

  4. It is another example of the demented “leadership” we have in this pathetic rubbished country. I suppose the ANC flag with a spear has no connection to the killings going on in the country. I am ashamed to invite my friends here (in any case, a few have cancelled who wanted to visit) and when I go abroad I say I am from Germany. It is the result of the 30% pass rate that we have to endure such childishness. The priorities are ignored. Why? Because of the incompetence of those who are supposed to lead but cannot lead a trained dog across an empty road in broad daylight.
